DESCRIPTION: Jury selection and voir dire are two of the most critical, potentially fruitful, and yet neglected part of a criminal trial. During this interactive program attendees will learn to think about jury selection and voir dire in a novel ways while gaining new techniques, tools, and strategies for implementing them including:

OUR PRESENTER: Ira Mickenberg is a criminal defense lawyer, defender trainer, and consultant from Saratoga Springs, NY. Ira has designed and taught hundreds of trial, appellate, post-conviction, and capital training programs for public defender organizations across the United States for more than three decades. He has also represented indigent defendants in the United States Supreme Court and Courts of Appeal as well as the highest appellate courts of several states. He has also done extensive felony work at the trial court level. From 1988-1994 Ira was founder and Attorney-In-Charge of the Office of the Appellate Defender in New York City. Ira has been certified as an expert witness in the federal courts on the subject of the effective assistance of counsel and has taught criminal law and procedure and appellate advocacy at American University School of Law, New York Law School, the University of Dayton School of Law, and Williams College.
Ira’s three previous presentations in Rhode Island Real Life Persuasive Brady Litigation (June, 2007); Telling the Client’s Story: Persuasive Sentencing Advocacy (May, 2008); and Telling the Mistaken Eyewitness Identification Story (May, 2009) were three of the most successful and well attended in the 20 + years of training collaboration between the Office of the Public Defender and RIACDL.

Subject to Supreme Court Rule IV.3, this program has been approved by the MCLE Commission for a maximum of 6.0 credits. This program has also been approved for credit towards re-certification of court appointed counsel. This program also satisfies 6.0 hours of the CLE requirement for criminal case panels in the District, Superior, and Supreme Courts.

PART V of Defense of Eyewitness Identification Cases, Voir Dire, will conclude the two year cycle of training by the Office of the Public Defender (OPD) in the various aspects of defending these types of cases. Relying upon:
- Established Rhode Island law supporting liberal attorney conducted voir dire
- Practice Tips
- Principles of effective voir dire in Eyewitness Identification Cases
Attendees will learn to organize and implement an effective, liberal, and attorney conducted voir dire generally in an eyewitness identification case in particular. Although OPD attorneys are required to attend this training as part of its free in-house training program, RIACDL members and others are invited and welcome to attend at nominal cost. Those attending will receive 1.5 hours if in-house CLE credit and a comprehensive set of written materials.
